Clarke – Real-Time Encryption & Decryption Software

Company: Clarke Technologies Private Limited (“Clarke”, “we”, “us”, “our”)

1. Acceptance of Terms

By accessing, downloading, or using Clarke on any platform (MacOS, Windows, Linux, Web, iOS, Android, iPadOS, WatchOS, tvOS, ChromeOS, Smart TVs, AR/VR headsets, or any future supported device), you (“User”, “you”, “your”) agree to these Terms of Service and our Privacy Policy.

If you do not agree, please do not use Clarke.

2. License and Access

Clarke grants you a limited, non-exclusive, non-transferable, and revocable license to use the application solely for personal or authorized business purposes in accordance with this ToS.

Platforms Covered:

• Desktop: MacOS, Windows, Linux, ChromeOS

• Mobile & Tablets: iOS, Android, iPadOS

• Wearables & TVs: WatchOS, tvOS, Smart TVs

• Emerging Tech: Web, AR/VR Devices, Spatial Computing Platforms, Quantum Systems (future)

3. User Responsibilities

You agree to:

• Use Clarke only for lawful purposes.

• Not reverse engineer, decompile, or tamper with the app or its encryption protocols.

• Ensure your account credentials and encryption keys are secure.

• Respect intellectual property and the rights of other users.

4. Data and Security

Clarke is a Zero-Knowledge Encryption Platform. We do not store or access your encryption keys or file contents.

You are responsible for securely managing:

• Your encryption keys

• Local backups

• Account credentials

If lost, we cannot recover your encrypted data.

5. Subscription & Payments

Clarke operates on a SaaS subscription and one-time license model:

• Individual Plan: €9.99/month or €99/year

• Business Plan: €25/user/month

• Enterprise Licensing: €100K+/year

Payment processors (e.g., Stripe, Apple, Google) manage your transactions. Subscription terms and cancellations are governed by their respective policies.

6. Modifications and Updates

We may:

• Modify features or update encryption standards

• Change platform support or discontinue services

• Automatically apply patches, security updates, or new features

We will notify users of major changes, but minor improvements may occur silently in the background.

7. Prohibited Use

You may not use Clarke to:

• Commit or assist criminal activity

• Violate encryption laws in your country

• Share or distribute malicious or harmful content

• Attempt to bypass our integrity checks or abuse beta versions

8. Intellectual Property

Clarke, including its UI/UX, branding, logos, encryption engine, AI Copilot, and educational games, is the intellectual property of Clarke Technologies Pvt. Ltd.

You may not reuse, redistribute, or commercialize Clarke without written consent.

9. Termination

We may suspend or terminate your access if you:

• Violate this ToS

• Abuse the software or APIs

• Endanger our infrastructure or compromise other users’ security

You may delete your account at any time. We will not retain your keys or files post-deletion.

10. Disclaimer of Warranties

Clarke is provided “as-is” and “as-available”. While we strive for excellence, we do not guarantee:

• That Clarke will be uninterrupted or error-free

• That your encryption keys will be recoverable

• That Clarke will function identically on all platforms at all times

Use Clarke at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law:

• Clarke is not liable for lost data, corrupted files, missed communications, or business losses resulting from use of the app

• Our liability is limited to the amount you paid in the last 12 months

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes will be resolved in the courts of Mumbai, Maharashtra.

14. Changes to Terms

We reserve the right to modify this ToS. Updates will be posted on our official website or app, and continued use implies acceptance.
